En 2013, con el apoyo de la Fundación Ford e investigadores locales, Americas Quarterly llevó a cabo un estudio comparativo sobre el marco legal y la implementación de la consulta previa en proyectos e inversiones extractivas y de infraestructura en cuatro países: Chile, Colombia, Guatemala y Perú.
Nuestros investigadores examinaron cómo cada país ha adoptado el Convenio 169 de la Organización Internacional del Trabajo (OIT), un tratado internacional que establece los derechos de los pueblos indígenas y tribales, incluyendo su derecho de ser consultados sobre medidas legislativas y administrativas o proyectos de inversión que puedan afectarles directamente.
En Perú, los investigadores Cynthia Sanborn, Verónica Hurtado y Tania Ramírez examinaron tres estudios de caso emblemáticos de consulta previa: el área de conservación regional Maijuna-Kichwa (ACR Maijuna-Kichwa) en la región de Loreto; los lotes petroleros de PERUPETRO S.A. y Pluspetrol en la Amazonía; y la exploración minera en San Juan Bautista Cañaris en la región de Lambayeque.
En Perú, los investigadores Cynthia Sanborn y Álvaro Paredes examinaron tres estudios de caso emblemáticos de consulta previa: el área de conservación regional Maijuna-Kichwa (ACR Maijuna-Kichwa) en la región de Loreto; los lotes petroleros de PERUPETRO S.A. y Pluspetrol en la Amazonía; y la exploración minera en San Juan Bautista Cañaris en la región de Lambayeque. En mayo de 2014, Americas Quarterly lanzó una edición especial dedicada al tema de consulta previa en las Américas.

En cada país, el equipo de Americas Quarterly investigó el marco legal y regulatorio de la consulta previa, los organismos del Estado encargados de implementarla, y la evolución de la jurisprudencia nacional acerca del tema. También analizó la eficacia de las autoridades nacionales y locales en promover las leyes y reglamentos, y observó el contexto comunitario y las relaciones entre el Estado, las comunidades indígenas y los inversionistas, en distintos lugares del país.
Cada caso de estudio presenta una serie de lecciones sobre cómo manejar tensiones comunitarias, fortalecer la institucionalidad, brindar seguridad jurídica a los inversionistas, y respetar los derechos de las comunidades indígenas.
With support from the Ford Foundation and local researchers, Americas Quarterly carried out a comparative research project in 2013 about the legal framework and the implementation of consulta previa for extractive and infrastructure projects in four countries: Chile, Colombia, Guatemala, and Peru.
Our researchers examined the different ways that countries in the hemisphere have adopted International Labour Organization Convention 169 (ILO 169), an international treaty that sets out the rights of indigenous and tribal peoples, including their right to be consulted about legislative and administrative measures or investment projects that have the potential to affect them directly.

In each country, Americas Quarterly researched the legal and regulatory framework of consulta previa, the state agencies charged with implementing it, and the evolution of national jurisprudence related to the topic. They also analyzed the quality and efficacy of the national and local state offices in terms of promoting the laws and regulations, and observed the community context and the relations between the state, indigenous communities, and investors in different parts of the country.
Each case study presents different lessons in addressing community tensions, strengthening institutional capacity, providing legal certainty to investors, and respecting the rights of indigenous communities. In May 2014, Americas Quarterly launched a special issue dedicated to the topic of consulta previa in the Americas.
